Sprout’s Juicy Juice® “My Refrigerator” Contest
Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN.
The Sprout’s Juicy Juice® “My Refrigerator” Contest (“Contest”) starts on April
13, 2009 at 12:01 AM Eastern Time (“ET”) and ends on May 15, 2009 at 11:59 PM ET
(“Contest Period”).
ELIGIBILITY: Contest is open to legal residents of the 48 contiguous
United States and the District of Columbia, who are of the age of majority in the
jurisdiction in which they reside (and at least 18 years of age). Employees of PBS
KIDS Sprout and Nestlé® USA (“Sponsors”), Children’s Network LLC, its programming
partners, and their respective parents, members, subsidiaries, affiliates, and advertising
and promotion agencies, and members of their immediate family (spouse, parent, child,
sibling and their respective spouses, regardless of where they reside) and persons
living in the same household of such employee, whether or not related, are not eligible
to enter or win. Void where prohibited by law. Contest is subject to all applicable
federal, state and local laws.
HOW TO ENTER: During the Contest Period, to enter, visit www.SproutOnline.com
and follow the directions provided to submit a color photograph of your refrigerator
displaying your preschooler’s art featuring Sprout characters. Photograph must be
submitted in GIF or JPEG format and cannot be larger than one (1) MB. All entries
must be received by 11:59 p.m. ET on May 15, 2009. Limit one (1) entry per person/email
address/household. All entries become the sole property of the Sponsors and will
not be returned.
Artwork in photograph must be entrant’s preschooler’s own work. Photograph must
be taken by entrant, previously unpublished, and cannot have been submitted in connection
with any other contest. Entry must be in keeping with the Sponsors images and may
not be offensive or inappropriate, as determined by the Sponsors in their sole discretion,
nor can it defame or invade publicity rights or privacy of any person, living or
deceased, or otherwise infringe upon any person’s personal or property rights or
any other third party rights. Sponsors reserve the right to disqualify any entry
in which there are non-Sprout characters, that is in Sponsors sole discretion offensive
or inappropriate, not in keeping with Sponsors’ images or that is otherwise not
in compliance with these rules.
JUDGING: There will be two (2) rounds of judging: Round 1: All
eligible entries received by Sponsors will be judged by a panel of qualified judges
equally on the following criteria: creativity in use of Sprout characters, appearance
and innovation, to determine the top five (5) scoring entries (“finalists”). In
the event of a tie, an additional, “tie-breaking” judge will determine the finalist(s)
based on the criteria listed herein. Sponsors reserve the right to select fewer
than five (5) finalists if, in their sole discretion, they do not receive a sufficient
number of eligible and qualified entries. Judges’ decisions are final and binding
on all matters relating to this Contest. Round 2: Between 12:01 a.m. ET on June
1, 2009 and 11:59 p.m. ET on June 7, 2009 (“Online Voting Period”), finalists will
be posted on www.SproutOnline.com. Visitors to www.SproutOnline.com will have the
opportunity to view the finalists and cast a vote for their favorite. All votes
must be received by 11:59 p.m. ET on June 7, 2009. Votes generated by script, macro
or other automated means or with the intent to impair the integrity of the voting
process, as determined by Sponsors in their sole discretion, will be void. Finalists
are prohibited from obtaining votes by any fraudulent or inappropriate means, including,
without limitation, offering prizes or other inducements to members of the public,
as determined by Sponsors in their sole discretion. The finalist who receives the
most votes, as determined by Sponsors in their sole discretion, will be deemed the
Grand Prize winner, subject to verification of eligibility and compliance with the
terms of these rules. Released Parties are not responsible for entries that, for
whatever reason, do not receive any votes.
WINNER NOTIFICATION: Potential Grand Prize winner (who will be
the eligible individual submitting the entry and not the preschooler whose art is
depicted) will be notified by telephone, mail and/or email on or about June 9, 2009
and will be required to execute an Affidavit of Eligibility, Liability Release and
Publicity Release (unless prohibited by law), which must be returned by the date
appearing on prize notification. Return of prize or prize notification as undeliverable,
failure to execute and return requested documentation within the allotted timeframe,
Sponsors’ inability to contact potential winner within a reasonable time period
or noncompliance with these Official Rules by potential winner will result in disqualification
and, at Sponsors’ discretion, the prize may be awarded to the runner-up. Sponsors
reserve the right to notify winner and/or award the prize in person and to record,
photograph and videotape the visit and any other activities in which winner may
be involved at such time and to use and permit use of said recordings, and the name,
likeness, performance and statements of the winner embodied therein, in any and
all media now known or hereafter created throughout the world in perpetuity, without
further compensation, approval or notice. Once winner has returned all paperwork
and has been fully qualified, the winner and his/her entry and information will
be posted on www.SproutOnline.com. This is anticipated to occur the week of June
22, 2009 and will remain on the site for a two-week period thereafter.
PRIZES/ODDS: Odds of winning depend on the number of eligible entries
received. One (1) Grand Prize will be awarded consisting of the following: a trip
for four (4) people to Philadelphia, PA for 3 days/2 nights (the "Trip"). The Trip
consists of (i) round trip coach class air transportation for four (4) on a carrier
of Sponsors’ choice from the major airport closest to winner's residence to Philadelphia,
PA; (ii) two standard hotel room accommodations (double occupancy, double room;
room rate and tax only) for two (2) nights in Philadelphia, PA; (iii) mid-sized
rental vehicle for duration of prize package in Philadelphia (note: primary renter
must be 25 years of age or older and be in possession of a major credit card and
valid driver’s license in the same name.); (iv) daily breakfast for each guest at
the hotel; (v) daily valet parking for one vehicle for the duration of the prize
package; (vi) dinner for four at a restaurant of Sponsors’ choice; (vii) Access
for four (4) to a taping of The Sunny Side Up Show (the “Show”) including a meet
and greet opportunity with the show talent.
The total approximate retail value ("ARV") of the Grand Prize will not exceed $6,120.00.
The actual value will vary depending on winner’s city of departure. Therefore, the
actual value of the Grand Prize awarded may be lower or higher than the ARV at the
time of fulfillment. If the actual value exceeds the stated ARV, the difference
will not be awarded in cash. Sponsor may substitute for air travel if winner lives
in close proximity to Philadelphia. All expenses or costs incurred by winner or
winner's travel companions associated with the Grand Prize receipt or use that are
not specifically and expressly stated herein above are not included in the Grand
Prize package and are the sole responsibility of the winner and his/her travel companions.
Such expenses and costs may include, without limitation, any additional ground transportation,
meals, incidentals, tips, telephone calls or other personal expenses and costs not
specified herein but relating to the use or acceptance of the Grand Prize package
which are the sole responsibility of the Grand Prize winner and his/her travel companions.
Travel must be completed by July 31, 2010, or winner may forfeit prize. Travel is
subject to availability and blackout periods. Selection of airline carrier and hotel
are at the sole discretion of Sponsors. Additional restrictions may apply. Grand
Prize winner and his/her travel companions will be required to travel on the identical
itinerary. Grand Prize winner and travel companions are responsible for obtaining
identification documents and/or other travel documents required for the Trip. Sponsors
will not replace any lost or stolen tickets, vouchers, certificates, prizes or prize
components once they are in the Grand Prize winner's possession. No transfer, or
cash or other substitution of any prize allowed except if any element of the Grand
Prize is postponed or cancelled for any reason after travel is arranged, the balance
of trip will be awarded in full satisfaction of prize, and no additional prize will
be awarded. Sponsors reserve the right to cancel the Show. Travel and accommodations
are subject to availability and certain restrictions.
All taxes and all expenses related to acceptance and use of prize and not specified
herein are the sole responsibility of winners. Winner will be issued an IRS 1099
form for the approximate retail value of their prize. The travel companions or their
legal guardians of potential Grand Prize winner must sign and return a Liability
and Publicity Release prior to travel documents being issued, except where prohibited.
Such documents must be signed and returned by the date and/or time indicated within
such documents. If a potential winner fails to return required documentation in
a timely manner, the prize will be forfeited and an alternate winner will be selected.
OWNERSHIP/USE: By submitting an entry, entrant agrees that Sponsors
shall own the entry submitted (including all rights embodied therein) and that they
and their designees may exploit, edit, modify, and distribute the entry and all
elements of such entry, in any and all media (including on www.Sproutonline.com
for online voting) now known or not currently known, throughout the world in perpetuity
without compensation, permission or notification to entrant or any third party.
GENERAL: By participating, each entrant agrees: (a) to abide by
these Official Rules and decisions of Sponsors and judges, which shall be final
and binding in all respects relating to this Contest; (b) to release, discharge
and hold harmless Sponsors, Children’s Network LLC, its programming partners, and
their respective parents, members, affiliates, subsidiaries, and advertising and
promotion agencies, and the respective officers, directors, shareholders, employees,
agents and representatives of the forgoing (collectively, “Released Parties”) from
any and all injuries, liability, losses and damages of any kind to persons, including
death, or property resulting, in whole or in part, directly or indirectly, from
entrant’s participation in the Contest, the acceptance, possession, use or misuse
of any awarded prize or Released Parties’ use of any of the rights granted herein
or any use of entry submitted; and (c) to the use of his/her name, city and state
of residence, photograph/video, image and/or likeness for programming, advertising,
publicity and promotional purposes in any and all media, now or hereafter known,
worldwide and on the Internet, and in perpetuity by Sponsors and their designees,
without compensation (unless prohibited by law) or additional consents from entrant
or any third party and without prior notice, approval or inspection, and to execute
specific consent to such use if asked to do so.
Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen,
misdirected, undelivered or garbled entries or votes; or for lost, interrupted or
unavailable network, server, Internet Service Provider (ISP), website, or other
connections, availability or accessibility or miscommunications or failed computer,
satellite, telephone or cable transmissions, lines, or technical failure or jumbled,
scrambled, delayed, or misdirected transmissions or computer hardware or software
malfunctions, failures or difficulties, or other errors or difficulties of any kind
whether human, mechanical, electronic, computer, network, typographical, printing
or otherwise relating to or in connection with the Contest, including, without limitation,
errors or difficulties which may occur in connection with the administration of
the Contest, the processing or judging of entries, the tabulating of votes, the
announcement of the prizes or in any Contest-related materials. Released Parties
are also not responsible for any incorrect or inaccurate information, whether caused
by site users, tampering, hacking, or by any equipment or programming associated
with or utilized in the Contest. Released Parties are not responsible for injury
or damage to participants' or to any other person's computer related to or resulting
from participating in this Contest or downloading materials from or use of the web
site. Persons who tamper with or abuse any aspect of the Contest or website or who
are in violation of these Official Rules or who attempt to undermine the legitimate
operation of the Contest by cheating, deception or other unfair playing practices,
or intend to annoy, abuse, threaten or harass any other entrant or Sponsors’ representatives,
as solely determined by Sponsors, will be disqualified and all associated entries
will be void. ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF
THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT
BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING
ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING
CRIMINAL PROSECUTION. Should any portion of the Contest be, in Sponsors’ sole opinion,
compromised by virus, worms, bugs, non-authorized human intervention or other causes
which, in the sole opinion of the Sponsors, corrupt or impair the administration,
security, fairness or proper play, or submission of entries, Sponsors reserve the
right at their sole discretion to suspend, modify or terminate the Contest and,
if terminated, at their discretion, award the prize from all eligible, non-suspect
entries received prior to action taken using judging procedure specified above.
