The Sprout’s “Dancing with the Dads” Sweepstakes (“Sweepstakes”) starts on May 7,
2009 at 12:01 AM Eastern Time (“ET”) and ends on June 14, 2009 at 11:59 PM ET (“Sweepstakes
Period”).
ELIGIBILITY: Sweepstakes is open to legal residents of the 48 contiguous
United States and the District of Columbia, who are of legal age of majority in
the jurisdiction in which they reside (and at least 18 years of age) with a child
or legal ward between 2-6 years of age. Entries should only be submitted by a parent
or legal guardian of the child or legal ward [please confirm]. Employees of PBS
KIDS Sprout (“Sponsor”), Children’s Network LLC, its programming partners, and their
respective parents, members, subsidiaries, affiliates, and advertising and promotion
agencies, and members of their immediate family (spouse, parent, child, sibling
and their respective spouses, regardless of where they reside) and persons living
in the same household of such employees, whether or not related, are not eligible
to enter or win. Void in AK and HI and where prohibited by law. Sweepstakes is subject
to all applicable federal, state and local laws.
HOW TO ENTER: There are two ways to enter this promotion during the Sweepstakes Period:
- Visit www.SproutOnline.com and follow the directions provided to complete the login/registration process. Entrants will then be asked to personalize the game with photos of the preschooler and his/her father and select body types and dance moves. Once the customized dance is complete, select the “Enter the Sweepstakes” option to submit your entry.
- Submit a 3 x 5 postcard to: Dancing with the Dads Sweepstakes Entry, Attention: E. Calabro, One Comcast Center, 30th Floor, Philadelphia, PA 19103. Postcard to include first and last name of parent/guardian, first name of preschooler and a valid email address.
You may choose
not to submit a Dance as part of your entry. Submitting a Dance as part of your
entry is optional and will not increase your chances of winning. NOTE: As an alternative
to making the Dance optional, the alternate method of entry may be via mail to
PBS KIDS Sprout, Dancing with the Dads Sweepstakes Entry, Attention: E. Calabro,
One Comcast Center, 30th Floor, Philadelphia, PA 19103. Regardless of mode of entry, all entries must be received
by 11:59 p.m. ET on June 14, 2009. Limit one (1) entry per person and per email
address/household per day. Entries received from any person, email address or household
in excess of the stated daily limitation will be void. Entries generated by script,
macro or other automated means and entries by any means which subvert the entry
process will be void. All entries become the sole property of the Sponsor and will
not be returned.
Entry (including Dance) must only contain photos exclusively featuring your preschooler
and/or his/her father, be in keeping with the Sponsor’s image and may not be offensive
or inappropriate, as determined by the Sponsor in its sole discretion, nor can it
defame or invade publicity rights or privacy of any person, living or deceased,
or otherwise infringe upon any person’s personal or property rights or any other
third party rights. Sponsor reserves the right to disqualify any entry in which
third parties other than your preschooler and his/her father appear in the Dance,
that is in Sponsor’s sole discretion offensive or inappropriate, not in keeping
with Sponsor’s image or that is otherwise not in compliance with these Official
Rules.
By submitting a Dance, entrant hereby grants permission for the Dance to be posted
on www.Sproutonline.com or other websites and
on the Sprout linear channel. Entrant agrees that Released Parties (as defined below)
are not responsible for any unauthorized use of Dances by third parties. Released
Parties do not guarantee the posting of any Dance.
RANDOM DRAWING – PRIZE – ODDS OF WINNING: On or about June 16,
2009, an independent judging organization will conduct a random drawing from among
all eligible entries received to select one (1) potential winner.
One (1) Grand Prize: a Nintendo Wii Game Console with accessories. Approximate
Retail Value (“ARV”) of Grand Prize is $599. Exact accessories to be determined
by Sponsor. Prize is awarded “as is” with no warranty or guarantee either express
or implied by Sponsor. Winner is responsible for all federal, state and local taxes
and any other costs and expenses associated with prize acceptance and use not specified
herein as being provided. No transfer, substitution or cash-redemption of prize
is permitted, except by Sponsor, which reserves the right to substitute the prize
with one of comparable or greater value. All prize details are at Sponsor’s sole
discretion.
Odds of winning will depend on the number of eligible entries received.
WINNER NOTIFICATION: Potential Grand Prize winner (who will be
the eligible individual submitting the entry and not the preschooler featured in
the Dance) will be notified by telephone, mail and/or email on or about June 16,
2009 and will be required to execute an Affidavit of Eligibility, Liability Release
and Publicity Release (unless prohibited by law), which must be returned by the
date appearing on prize notification. Return of prize or prize notification as undeliverable,
failure to execute and return requested documentation within the allotted timeframe,
Sponsor’s inability to contact potential winner within a reasonable time period
or noncompliance with these Official Rules by potential winner will result in disqualification
and, at Sponsor’s discretion, the prize may be awarded to an alternate. Sponsor
reserves the right to notify winner and/or award the prize in person and to record,
photograph and videotape the visit and any other activities in which winner may
be involved at such time (collectively, the “Footage”). By accepting the prize,
winner agrees that Footage will be owned by Sponsor which (along with its designees),
shall have the right to use, edit, adapt, post, stream, copy and exploit such Footage
and all elements embodied therein, including the name, likeness, performance and
statements of the winner and his/her child or legal ward embodied therein, in any
and all media now known or hereafter created throughout the world in perpetuity,
without further compensation, approval or notice.
OWNERSHIP/USE: By submitting a Dance, entrant agrees that Sponsor
shall own the Dance submitted (including all rights embodied therein) and that it
and its designees may exploit, edit, modify, and distribute the Dance and all elements
of such Dance (including the likenesses embodied therein), in any and all media
now known or not currently known, throughout the world in perpetuity without compensation,
permission or notification to entrant or any third party.
GENERAL: By participating, each entrant agrees: (a) to abide by
these Official Rules and decisions of Sponsor and judges, which shall be final and
binding in all respects relating to this Sweepstakes; (b) to release, discharge
and hold harmless Sponsor, Children’s Network LLC, its programming partners, and
their respective parents, members, affiliates, subsidiaries, and advertising and
promotion agencies, and the respective officers, directors, shareholders, employees,
agents and representatives of the forgoing (collectively, “Released Parties”) from
any and all injuries, liability, losses and damages of any kind to persons, including
death, or property resulting, in whole or in part, directly or indirectly, from
entrant’s participation in the Sweepstakes, the acceptance, possession, use or misuse
of the awarded prize or Released Parties’ use of any of the rights granted herein
or any use of entry (including Dance) submitted; and (c) to the use of his/her name,
city and state of residence, photograph/video, image and/or likeness (including
Footage) for programming, advertising, publicity and promotional purposes in any
and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity
by Sponsor and its designees, without compensation (unless prohibited by law) or
additional consents from entrant or any third party and without prior notice, approval
or inspection, and to execute specific consent to such use if asked to do so.
Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen,
damaged, delayed, misdirected, undelivered or garbled entries or Dances; or for
lost, interrupted or unavailable network, server, Internet Service Provider (ISP),
website, or other connections, availability or accessibility or miscommunications
or failed computer, satellite, telephone or cable transmissions, lines, or technical
failure or jumbled, scrambled, delayed, or misdirected transmissions or computer
hardware or software malfunctions, failures or difficulties, or other errors or
difficulties of any kind whether human, mechanical, electronic, computer, network,
typographical, printing or otherwise relating to or in connection with the Sweepstakes,
including, without limitation, errors or difficulties which may occur in connection
with the administration of the Sweepstakes, the processing of entries, the announcement
of the prize or in any Sweepstakes-related materials. Released Parties are also
not responsible for any incorrect or inaccurate information, whether caused by site
users, tampering, hacking, or by any equipment or programming associated with or
utilized in the Sweepstakes. Released Parties are not responsible for injury or
damage to entrants' or to any other person's computer related to or resulting from
participating in this Sweepstakes or downloading materials from or use of the web
site. Persons who tamper with or abuse any aspect of the Sweepstakes or website
or who are in violation of these Official Rules or who attempt to undermine the
legitimate operation of the Sweepstakes by cheating, deception or other unfair playing
practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s
representatives, as solely determined by Sponsor, will be disqualified and all associated
entries will be void. ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION
OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH
AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES
(INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE
LAW, INCLUDING CRIMINAL PROSECUTION. Should any portion of the Sweepstakes be, in
Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human
intervention or other causes which, in the sole opinion of the Sponsor, corrupt
or impair the administration, security, fairness or proper play, or submission of
entries, Sponsor reserves the right at their sole discretion to suspend, modify
or terminate the Sweepstakes and, if terminated, at its discretion, select the winner
in a random drawing from among all eligible, non-suspect entries received up to
time of such termination. In the event of a dispute regarding entries received from
multiple users having the same e-mail account, the authorized subscriber of the
e-mail account at the time of entry will be deemed to be the entrant and must comply
with these Official Rules. Authorized account subscriber is the natural person who
is assigned the e-mail address by the Internet Service Provider (ISP), on-line service
provider, or other organization responsible for assigning e-mail addresses.
